Contractor Hawk provides digital marketing services for contractors and home-service businesses, including web design and development, SEO and local search optimization, paid advertising and lead generation, branding and graphic design, AI solutions, and analytics and tracking. The specific scope, deliverables, timeline, and fees for any engagement are defined in a separate proposal, agreement, or statement of work.
You must be at least 18 years old and authorized to enter into a binding agreement on behalf of your business to use our services.
To deliver results, we rely on you to provide accurate information, timely feedback, necessary access (such as website, hosting, domain, Google Business Profile, and ad accounts), and any content or approvals we reasonably request. Delays in providing these may affect timelines.
Fees are set out in your proposal or agreement. Unless stated otherwise, invoices are due as scheduled, and ongoing services may be billed monthly. Late or missed payments may result in paused work or suspension of services. Setup fees and third-party costs (such as ad spend, software, or stock assets) are non-refundable once incurred.
Upon full payment, you own the final deliverables we create specifically for you — including your website, content, photos, and creative assets. We retain ownership of our pre-existing tools, processes, templates, and know-how, and we may showcase completed work in our portfolio and case studies unless you request otherwise in writing.
Our services often rely on third-party platforms (such as Google, Meta, hosting providers, and software tools). We are not responsible for the availability, policies, pricing, or actions of those third parties, and their terms apply to your use of them.
We apply proven strategies and best practices, but, except for the written performance guarantee described below, we do not guarantee specific rankings, traffic, leads, or revenue. Results depend on many factors outside our control, including competition, market conditions, your trade, your budget, and third-party algorithm changes.
Performance guarantee. Where we offer our 60-day performance guarantee, it applies to our ongoing monthly marketing plans, not to one-time projects such as a standalone website build, and it works as follows: if you do not receive 10 new customers within the first 60 days after the agreed work goes live, we will work the third month free of charge. A “new customer” is a new booked job from a person who has not hired you before, with a name and a phone number, that came from the calls, forms, or messages generated by our marketing. The guarantee depends on your trade and market, and trades with longer sales cycles may need more time. The exact terms for your engagement are confirmed in your written proposal or agreement.
To the fullest extent permitted by law, Contractor Hawk shall not be liable for any indirect, incidental, or consequential damages, or for lost profits or revenue. Our total liability for any claim shall not exceed the fees you paid us for the services giving rise to the claim in the preceding three (3) months.
You agree to indemnify and hold Contractor Hawk harmless from claims, damages, or expenses arising from content you provide, your use of our deliverables, or your violation of these Terms or applicable law.
Either party may terminate an engagement as set out in the applicable agreement. Upon termination, you remain responsible for fees for work performed up to the termination date.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Houston, Harris County, Texas.
We may update these Terms from time to time. The “Last Updated” date above reflects the latest version. Continued use of our website or services after changes constitutes acceptance.
